Cancellation & Refund Policy

At Creative Augmentation, we value the trust you place in us when engaging our services. This Cancellation and Refund Policy outlines the terms that apply when a project is cancelled, paused, or modified after an agreement has been made. Please read this policy carefully before engaging our services.

1. Payment & Advance

All projects undertaken by Creative Augmentation require a 50% advance payment before any work begins. This advance is required to allocate resources, initiate project planning, and secure your position in our production schedule.

  • The advance payment must be received before any deliverables are produced or any work is commenced
  • The remaining 50% is due upon project completion, or as outlined in the individual project agreement
  • For larger projects, milestone-based payment schedules may be arranged as specified in the project contract

2. Cancellation Before Work Begins

If you choose to cancel a project before any work has commenced, you are entitled to a full refund of the advance payment, minus any direct expenses already incurred on your behalf.

Direct expenses that may be deducted include:

  • Third-party software or tool subscriptions purchased specifically for the project
  • Domain registrations or hosting fees already paid
  • Any preliminary research, consultations, or planning activities completed
  • Administrative or processing fees

To be eligible for this refund, the cancellation request must be submitted in writing via email before any project deliverables have been produced or shared.

3. Cancellation After Work Starts

Once work on a project has begun, the 50% advance payment becomes non-refundable. This is because resources have already been allocated, and work has been performed on your behalf.

  • Any deliverables completed up to the point of cancellation will be provided to the client
  • If additional work beyond the initial 50% value has been completed, the client will be invoiced for the balance
  • Creative Augmentation reserves the right to retain ownership of all deliverables until full payment has been received

Important: "Work has begun" is defined as any activity undertaken by Creative Augmentation or its partners after the advance has been received, including but not limited to research, planning, design, development, copywriting, campaign setup, or any other project-related tasks.

4. Non-Refundable Items

The following costs are non-refundable under any circumstances, regardless of when the project is cancelled:

  • Third-party subscriptions: Any software, tools, or platform subscriptions purchased on behalf of the client
  • Server and hosting costs: Fees paid for servers, cloud services, CDNs, or hosting environments
  • Licensed software: Any commercial software licences acquired for the project
  • Services already performed: Any work, consultations, audits, or deliverables already completed and/or shared
  • Ad spend: Any advertising budget that has already been spent on live campaigns
  • Third-party vendor fees: Payments made to freelancers, contractors, or other vendors working on the project

5. Long-term Contracts

For ongoing or retainer-based engagements, special cancellation terms may apply as outlined in the individual contract agreement. These may include:

  • A minimum commitment period during which cancellation is not permitted without penalty
  • A notice period (typically 30 days) required before cancellation takes effect
  • Early termination fees as specified in the contract
  • Transition period obligations to ensure continuity of services

In the absence of a specific contract clause addressing cancellation, the general terms of this Cancellation and Refund Policy shall apply.

6. Project Modifications

We understand that project requirements can evolve. Creative Augmentation accommodates scope changes subject to the following conditions:

  • All scope changes must be documented and agreed upon in writing by both parties
  • Additional charges may apply for features, pages, revisions, or services beyond the original project scope
  • A revised estimate will be provided and must be approved before additional work begins
  • Changes to scope may affect project timelines, and a revised delivery schedule will be communicated

Scope changes are not considered cancellations and are governed by the additional terms agreed upon at the time of the modification.

7. Delays Due to Client

Creative Augmentation is committed to delivering projects on time. However, if delays occur due to client inaction, late feedback, or failure to provide necessary materials, the following applies:

  • Creative Augmentation reserves the right to adjust the project timeline accordingly
  • If client-caused delays extend the project beyond the originally agreed timeline, additional fees may be charged to account for extended resource allocation
  • Projects that remain inactive for more than 30 days due to client inaction may be considered abandoned, and the advance payment will be forfeited
  • Restarting an abandoned project may require a new advance payment and revised project agreement

Note: We always strive to work collaboratively and will send reminders before marking any project as inactive or abandoned. Communication is key, and we encourage clients to reach out proactively if they anticipate any delays.
